- Your Right to Use the Site and Its Contents
This Site is for your personal use only. You may not distribute, exchange, modify, sell, or transmit anything you copy from this Site, including but not limited to any text, images, audio, and video, for any business, commercial, or public purpose. As long as you comply with the terms of these Terms and Conditions of Use, DISTools LLC grants you a non-exclusive, non-transferable, limited right to enter, display, and use this Site. You agree not to interrupt or attempt to interrupt the operation of this Site in any way.
- Ownership
All materials on this Site, including but are not limited to audio, images, software, text, and video clips (the "Content"), are protected by copyright under U.S. copyright law, international conventions, and other copyright laws. You cannot use the Content, except as specified herein. You agree to follow all instructions on this Site limiting the way you may use the Content. There are a number of proprietary logos, service marks, and trademarks found on this Site. By making them available on this Site, DISTools LLC is not granting you any license to utilize those proprietary logos, service marks, or trademarks. Any unauthorized use of the Content may violate copyright laws, trademark laws, the laws of privacy and publicity, and civil and criminal statutes.
You may download one (1) copy only of the Content to be used only by you for your personal use at home/business, unless the sub site you are accessing states that you may not. If you download any Content from this Site, you may not remove any copyright or trademark notices or other notices that go with it.
- DISTools LLC's Rights to User's Material
If you send any communications or materials to the Site by electronic mail or otherwise, including any comments, data, questions, suggestions, or the like, all such communications are, and will be treated as, non-confidential and non-proprietary. Thus, you give up any claim that any use of such material violates any of your rights including moral rights, privacy rights, proprietary or other property rights, publicity rights, rights to credit for material or ideas, or any other right, including the right to approve the way DISTools LLC uses such material.
Any material submitted to this Site may be adapted, broadcast, changed, copied, disclosed, licensed, performed, posted, published, sold, transmitted, or used by DISTools LLC anywhere in the world, in any medium, forever. Furthermore, DISTools LLC is free to use, without any compensation to you, any concepts, ideas, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products using such information. However, you agree and understand that DISTools LLC is not obligated to use any such ideas or materials, and you have no rights to compel such use.
- DISTools LLC grants DigiDIS owner's to use our manuals and to update their printed version form our manual web site. This right is not transferred if this DigiDIS is sold to a third party.

This website may contain links to other Internet sites on the World Wide Web. DISTools LLC provides such links for your convenience only, and is not responsible for the content of any website linked to or from this Site. Links from this Site to any other website do not mean that DISTools LLC approves of, endorses, or recommends that website. DISTools LLC disclaims all warranties, express or implied, as to the accuracy, legality, reliability, or validity of any content on any other website.
- DISTools LLC's Right to Change These Terms and Conditions of Use or Content on the Site
DISTools LLC may add to, change, or remove any part of these Terms and Conditions of Use at any time, without notice. Any changes to these Terms and Conditions of Use or any terms posted on this Site apply as soon as they are posted. By continuing to use this Site after any changes are posted, you are indicating your acceptance of those changes. DISTools LLC may add, change, discontinue, remove, or suspend any other Content posted on this Site, including features and specifications of products described or depicted on the Site, temporarily or permanently, at any time, without notice and without liability.
- Sales and Returns
DigiDIS and all software sales are final. DISTools LLC requires all DigiDIS sales within the US to prior signing of the end user agreement (the DigiDIS is sold for lawful use only).
- All returnable merchandise has a minimum of $50 return fee or 10% of the invoice value; whatever is higher.
- Cancelled orders which required a deposit are handled as a return item, even if the merchandise was not shipped to the customers.
- Payments, Fees, returned Checks and penalties
All non North American orders must be paid in full in advance by bank wire or Letter of Credit (LOC). There is a $35 fee for all bank wires and a $350 fee for LOC's. All first time orders over $300 must be paid in advance by secure payment (cash, cashier check, Bank Money Order, or PMO).
- Unpaid checks (returned by bank for "Stop Payment", "ISF" or any other reason) will be charged a minimum of $50 fee or 10% of the amount, whatever is greater; if paid within the next business day after the customer was notified. If checks over $500 are not paid within 5 business days after notification, a $150 service fee will be charged in addition. Checks for or more then $1,000 will be charged a $200 fee after 5 business days in addition. These fees are again charged after every following 5 days up to 30 days. A 20% interest rate is charged for the owed amount and fees after the 30th day, as well as court and attorney fees. If a claim is filed, it will be three times of the amount of the unpaid check and attorney and court fees.
- All invoices must be paid within 15 days. If invoices are not paid within this time frame, a service fee of $25 will be charged and a reminder is send. Is the invoice over $500 and amount is owed longer then 40 days, policy #10 applies to these cases. Invoices under $100 will be charged $25 every time a reminder is send out, which will be no more then once every 90 days.
- All fees will be enforced through legal representation and perused nationally and internationally.
- DISTools LLC reserves the right, to use any technical method to prevent the customer from using the merchandise until the account is settled.
- All merchandise is the unlimited property of DISTools LLC until customer paid it in full, including shipping or any other fees.
- If a customer attempts to copy the DigiDIS hardware; and or copy anything out of our manuals, we will charge a minimum penalty fee of US$10,000.00. If there was any commercial gain for the copying person, the penalty is US$100.000.00.
- Language
DISTools LLC business language is English. All mail should be in English and DISTools LLC has the right to refuse any letters and/or e-mails in any other language than English and sees those letters as not received and therefore without legal base.
- The Right to refuse
DISTools LLC reserves the right to refuse service for any reason to anyone. If a customer attempts to copy any part of our hardware, software and/or our manual, we refuse any future service to this customer.
- Technical Support
Technical support is provided to all DISTools LLC customers without charge from M-F 9-5 EST by e-mail. Technical support can be suspended after one year of purchase or if customer uses bad and/or abusage language or has an unpaid account or if customer has no purchase of upgrades for over a year.
- Warranty
All products sold by DISTools LLC are warranted one year in parts and labor. Shipping expenses are charged to the customer.
- Using DISTools LLC Products
The usage of any product sold by DISTools LLC the user has the sole responsibility and does so at his/her own risk and DISTools LLC is not responsible for any damage which might have been caused by this product. The buyer shall indemnify, defend, and hold harmless, DISTools LLC from and against all damages, claims, expenses, losses, or unlawful use of any of our products, according to the laws of the state in which the product is being sold or used in.
- Shipping
DISTools LLC is not responsible for any lost merchandise send to us or shipped form us back to the customer.
- All repairs have to be send to our house address by UPS, USPS or FedEx. DISTools LLC reserves the right to ship items back with the carrier we chose. The shipping expenses will be charged to the customer. If a repair requires shipping out of the US, DISTools LLC is under no obligation to do so by Air Mail, UPS or FedEx and can send items by regular USPS service.
- Policy Governs Use; Changes to Privacy Policy
The terms of this policy will govern the use and any information collected while it is in place. DISTools LLC reserves the right to change this policy at any time, so please re-visit this page as often as you wish. Changes to this privacy policy are effective at the time they are posted to this Site.
- Privacy Policy
DISTools LLC is committed to protecting your privacy. DISTools LLC retains only the purchase records from our customers. All information is protected against unauthorized access. No other information is gathered nor do we sell or distribute any customer information to 3rd parties.
